ADiMS is an online diary management system for ADI (Approved Driving Instructor). ADiMS is developed and maintained by AKG Dynamics Ltd. (Company Number 09809502).

These terms and conditions govern your use of services provided by ADiMS. Please read this agreement carefully before activating/using your ADiMS account. By visiting our site and/or purchasing from us, you engage in our "services" and agree to the bond by the following terms and conditions ("Terms of Service", "Terms") including the additional terms, policies referenced here in and/or available by hyperlink.

By activating or continuing to use ADiMS after publication of this agreement, you confirm that you have read, understood and accept this agreement. If there is anything you do not understand please contact customer services at info@adims.co.uk. You will at all times remain fully and solely responsible for all use of ADiMS.

Section 1. Scope of this Agreement

This agreement will be solely exclusively between you and us (ADiMS). This agreement is written and available only in English and we undertake to communicate with you in English regarding any aspect of ADiMS.

Section 2. Terms of Service & General Conditions

ADiMS provide online application for driving instructors in UK, to enable them to manage their lessons booking, students and accounts. ADiMS offer services to instructors and their students. By using ADiMS services, you agrees that we communicate with you by email and/or via ADiMS application or via app notifications for issuing any notices or information about your ADiMS account and therefore we recommend that you ensure you keep your email address updated via ADiMS application.

By agreeing to these Terms, you represent that you are of legal age in your country of residence, or that you have given the consent to allow any of your minor dependents to use this site.

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including payment information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Payment information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

You may not use our product or services for any illegal or unauthorised purpose nor may you violate any laws in your jurisdiction (including but not limited to copyright laws). You may not try to gain unauthorised access to data or services or ADiMS servers. You may not transmit any worms or viruses or any code of destruction nature. You may not attack ADiMS website or app in any way. This include Denial of Service attacks. We'll report any attack or attempt to gain unauthorized access to the relevant law enforcement authorities and share information about you with them.

A breach or violation of any of the Terms mentioned in this statement will result in an immediate termination of your services. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Section 3. ADiMS Account Registration

For Instructors You must open an account with ADiMS (an ADiMS Account) to use the services. ADiMS will ask for information including your name and other personal information. You must provide up to date, accurate and complete information. On registration ADiMS will send a verification email to the email address you provided during registration. You must complete your account verification by clicking on the link provided in the verification email. We reserve the right to block services or terminate your account without notice after the initial 30 days free trial if you don't verify your account.

You are fully responsible for all the activities that occur under your ADiMS account, including for any action taken by person to who you have granted access to your account. ADiMS reserves the right to suspend or terminate the account of any user who provide inaccurate, untrue or incomplete information or who failed to comply with account registration requirements. ADiMS is not responsible for any information/or any of the implications of the information added by the users in their ADiMS account.

For Students If your instructor uses ADiMS for managing his/her driving training school/business, he/she might send you an online form which is a feature of ADiMS that allows the creation of your student profile/account in ADiMS. You can use this account to view your lessons bookings, payment history and personal information.

By completing or submitting information through online form you agree to all the terms and conditions supplied in this statement. ADiMS is not responsible for any information (including lesson booking & payment) shown on your ADIMS account. If you believe that the information provided/shown in your ADiMS account is inaccurate/wrong please contact your driving instructor who provided you link to register or entered your details in ADiMS. If you are unable to reach your instructor, feel free to contact us at info@adims.co.uk. As your information is governed under your instructor's account, we will try our best to help you in any way we can.

For All Users (Instructors & Students) By registering with ADiMS, you agree to all the terms mentioned in this statement. You also agree that ADiMS can communicate with you using emails, app notifications which are essential to offer you services provided by ADiMS.

Section 4. Privacy Policy

By using ADiMS services (site and application) you consent to ADiMS privacy notice, which explains how ADiMS collects, use and process the personal information you provide to us.

Section 5. Modification of the Services and Prices

Prices for our products/services are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Section 6. Products or Services (if applicable)

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products/services or pricing are subject to change at anytime without notice, at our sole discretion. We reserve the right to discontinue any product/services at any time. Any offer for any product or service made on this site is void where prohibited.

We have made every effort to display as accurately as possible the colors and images of our products that appear on pur site/application. We cannot guarantee that your computer monitor's display of any color will be accurate.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We are not responsible if the information made available on this site is not accurate, complete or current. Any reliance on the material on this site or ADiMS app is at your own risk. We reserve the right to modify the content of this site at anytime, but we have no obligation to update any information on ADiMS. You agree that it is your responsibility to monitor changes our site.

We may update/add services and features offered by ADiMS. We are not responsible in informing you about such updates. You agree that it is your responsibility to keep yourself up-to date with all the latest updates of ADiMS. We shall not be liable to you or any third party, for any modification, price change, suspension or discontinuance of the services provided by ADiMS.

ADiMS may deem it necessary to amend the Terms or any additional policy (inc. privacy policy) at any time without notice. Each revised version will be effective as of the time it is posted.

Your continued use of services after posting revised/updated terms and policies, constitutes your acceptance of the revised terms and policies.

Section 8. Restrictions

In addition to any other prohibitions set forth in this statement, you are prohibited from using the site or its content a) for any unlawful purpose b) to solicit others to perform or participate in any unlawful acts. c) to submit false or misleading information, d) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operations of the services or of any related website, other website ot the internet. e) to collect or track or gain access to the personal information of others. f) to spam, phish, spider, crawl or scrape any information/content from the website. g) for any obscene or immoral purpose, h) to interfere with or circumvent the security features of the services or any related website/other websites, i) to violate any international, federal, provincial or state regulation, rules, law or local ordinances. j) to infringe upon or violate any intellectual property rights. k) to harass, abuse, insult, harm, deface or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability.

If ADiMS reasonably suspect that you have visited any of the prohibited uses, you give ADiMS authorisation to share information about you and your account activities with law enforcement. We reserve the right to terminate your use of the ADiMS services or any related website for violating/practising any of the prohibited uses.

Section 9. Errors, Inaccuracies & Omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability.

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

Section 10. Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made on ADiMS. You agree to promptly update your account and other information, including your email address and payment details, so that we can complete your transactions and contact you as needed.

Once you hve used the ADiMS services for initial 30 days Free Trial, you are only able to use the services by purchasing our subscription plans. You can stop the subscription at any time. Once the purchase is made, you agree to use the services defined by purchased subscription period. ADiMS is not responsible if you are unable to use the service for the purchased subscription period for any reason. ADiMS may increase the price depending on update/services provided and will be applicable to your ADiMS account when you purchase/renew/place an order for your next subscription. You will be notified prior to you next subscription payment via email. Once purchased, ADiMS does not offer refund. You can discontinue the service whenever you like.

Section 11. Optional Tools

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

In no case shall ADiMS, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
